JUDGE DENIES CIVIL AND CRIMINAL CONTEMPT MOTION FILED AGAINST NEXUS SERVICES INC.
New York Attorney General’s Motion To Hold Nexus Services In Contempt Of Court Was Denied This Morning. Nexus Vows To Protect Immigrants And Stand Firm On Company Principle Of Protecting Client Privacy.
New York, NY., January 10, 2018 – Judge Andrew Borrok in the Supreme Court of New York ruled against the New York Attorney General today on the AG’s motion for civil and criminal contempt against Nexus Services, Inc. The AG had requested fines and the imprisonment of Nexus CEO Mike Donovan. The Judge rejected the contempt motion and asked Libre to continue making weekly productions of their documents, redacted pursuant to the order of the New York appellate division. Libre by Nexus will make weekly productions of redacted material that will insure client confidential information will be protected from disclosure to the Trump deportation machine.
Libre by Nexus fought back against the New York AG because some of the information the Attorney General seeks is personal, confidential information of Nexus program participants that have nothing to do with a consumer inquiry and which could place their lives or cases in jeopardy. Mike Donovan, Nexus’s CEO, said today after the ruling “We are thankful that Judge Borrok denied the AG’s motion for contempt. We are hopeful that we can rise above the politics of immigration and actually work together to protect the immigrant community. We are willing partners in such an endeavor, and welcome any fair inquiry that protects our clients’ personal data. We are not, and will never be, willing to share confidential client data without protections that it will be secured. We have promised our clients that we would protect their confidential information, and that is a promise I intend to keep. This is even more important after President Trump’s ‘nine minutes of hate’ speech from his nationally televised address this week. For as long as the White House is occupied by an anti-immigrant demagogue Nexus will continue to fight to insure that our clients are protected from the Trump Deportation machine.”
Libre by Nexus will continue to produce redacted information in an effort to fully comply with any regulatory inquiry, but will absolutely fight against overly-broad requests that would put Nexus clients at risk.
